TERMS & CONDITIONS
The Seller is defined as Moss Douglas Pty Ltd. trading as Formline Engineered Accessories, or its successors or any person acting on behalf of, and with the authority of Moss Douglas Pty Ltd/Formline Engineered Accessories. The Customer is defined as any person on behalf of and with the authority of the Customer. Goods is defined as any products supplied by the Seller to the Customer. Services shall mean all Services supplied by the Seller to the Customer and includes any incidental supply of Goods. Debt shall mean any money that is owed to the Seller by the Customer. Price shall mean the cost of the Goods/Services as agreed between the Seller and the Customer.
ACCEPTANCE
Any instructions received by Formline from the Customer for the supply of goods or for the acceptance of goods constitutes acceptance of these Terms and Conditions.
PRIVACYFormline have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). See our separate Privacy Policy for details.
PAYMENT
All sales are due on receipt of invoice/s unless agreed terms are approved by Formline.
If the Customer fails to pay any invoice/s when due, the Customer forfeits the right of supply of Goods and/or Services until the outstanding debt is paid. Formline may at any time, refuse to supply the Customer with goods or services due to non-payment of Debt. Ownership of Goods remains with Formline until full payment of invoice/s. No claims are accepted unless made within 7 days of invoice date. Accepted payment methods are EFT (Electronic Funds Transfer/Bank Deposit), Visa or Mastercard, Paypal, cash or cheque.
PRICE
The price for Goods and Services is set by Formline at the time of sale. Formline reserves the right to change prices from time to time without notice. Where indicated as ex GST, the price will be increased by GST upon invoice. In the event of any claim whatsoever, the liability of Formline is limited to the price invoiced only.
FREIGHT/SHIPPING/POSTAGE
Formline will deliver Goods to the delivery address provided using Australia Post unless an alternative is specifically requested by the Customer. Note that some large items will require a specialist courier for a fee. Formline is not liable for delays in shipping once stock is dispatched from Formline premises. Shipping/freight/postage costs are the responsibility of the Customer. See Shipping Policy.
RETURNS
Customer rights for refund, return or repair are honoured by Formline under Australian Consumer Law. Exceptions apply to change of mind, competitor price, damage in transit or misuse. Products purchased with identified soiling or flaws are not eligible for refund or repair. Refunds are to be instigated in writing (by email or refund form) only. The Customer is responsible for returning the product if it can be posted or easily returned.
PRODUCT VARIATION
Formline is not responsible for variations in colour and texture of products created due to manufacturing. Variations in dye, pigment and materials, or changes to manufacturing practices are beyond the control of Formline.
DISCLAIMER
Any service provided by Formline in relation to Goods and/or Services sold (or for their use or application) is given in good faith and is believed to be appropriate and reliable. However, any advice, recommendation, information, assistance, or service provided by Formline in relation to any Goods and/or Services supplied is general in nature and provided without liability or responsibility.
Formline also makes no express or implied warranty of statement and expressly negates any implied or expressed warranty (other than as may be imposed by statute) that the goods and/or services will be suitable for a particular purpose or end use for which the Customer may use them. The Customer accepts all risk and responsibility for consequences arising from the use of goods and/or services, whether singularly or in combination with other products. No claims for consequential damages will be considered.
